Please read these terms and conditions carefully before using Our Service.

These Terms and Conditions constitute a legally binding agreement between You and the Company concerning Your access to and use of the Travel Assist Plus website and membership services.

Travel Assist Plus provides health-related membership services including 24-hour travel medical assistance, telemedicine consultations, air ambulance services, helicopter emergency transport, and personal health record storage through ICETracer. By accessing or using Our Service, You acknowledge that You have read, understood, and agree to be bound by these Terms.

1. Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

  • Account means a unique account created for You to access our Service or parts of our Service.
  • Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for election of directors or other managing authority.
  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Affinity Partners LLC, 16775 Addison Rd. Suite 612, Addison, TX 75001.
  • Content refers to any text, images, documents, health information, or other materials that You submit, upload, or transmit through the Service.
  • Country refers to: Texas, United States
  • Device means any device that can access the Service such as a computer, a cellphone, or a digital tablet.
  • Emergency Services means the emergency medical assistance services provided through the membership, including but not limited to medical evacuation, medical repatriation, air ambulance, helicopter emergency transport, and 24-hour assistance coordination.
  • Health Information means any information relating to Your physical or mental health, medical history, medical conditions, treatments, medications, prescriptions, allergies, and any other health-related data You provide to Us.
  • Medical Services means the health-related services offered through the membership, including telemedicine consultations, ICETracer medical records storage, and coordination of emergency medical care.
  • Membership means Your subscription to Travel Assist Plus services, which provides access to the benefits and services described herein.
  • Service refers to the Website and all related membership services including but not limited to travel assistance, telemedicine, air ambulance services, helicopter emergency transport, and medical records storage (ICETracer).
  • Service Provider means any natural or legal person who processes data or provides services on behalf of the Company, including telemedicine providers, air ambulance operators, and emergency assistance coordinators.
  • Subscription refers to the services or access to the Service offered on a subscription basis by the Company to You.
  • Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
  • Third Party means any entity other than the Company or You, including but not limited to medical service providers, insurance companies, healthcare facilities, emergency response services, and payment processors.
  • Website refers to Travel Assist Plus, accessible from https://travelassistplus.com
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

2. Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use, and disclosure of Your personal information when You use the Service. Please read Our Privacy Policy carefully before using Our Service.

3. Description of Services

Travel Assist Plus provides a comprehensive suite of health-related membership services designed to protect You and Your family during medical emergencies, particularly while traveling.

Travel Assistance

24-hour domestic and international emergency assistance when traveling more than one hundred (100) miles from Your permanent place of residence. Benefits include:

  • Evacuation and medically necessary repatriation coverage up to $100,000 combined
  • Transportation of mortal remains up to $20,000
  • Transportation of traveling companion up to $5,000
  • Transportation of dependent children up to $5,000
  • Vehicle return, medical monitoring, and insurance coordination

Helicopter Emergency Transport

Reimbursement up to $7,000 with no deductible per occurrence for life-threatening, certified injuries resulting from accidents that require emergency medical transportation by helicopter.

Air Ambulance

Acute care air transportation when a medical emergency occurs. You or Your covered dependents are transported to the hospital of Your choice by a dedicated medical aircraft equipped with doctors, nurses, and respiratory therapists.

Telemedicine

24/7 virtual healthcare access to U.S. board-certified physicians with $0 consult fees. Physicians can diagnose, treat, and prescribe medications for over 70% of acute medical conditions.

ICETracer Medical Records

A personal health record system to add, edit, and store life-saving emergency contact and medical information. In the event of an unforeseen accident, this information is available via a wallet card with a dedicated QR code to provide You with the best emergency care possible.

Service Availability

Service availability and specific benefits may vary based on Your membership plan and geographic location. Certain services have specific availability restrictions detailed in Section 7 (Service Limitations and Exclusions).

4. Eligibility and Registration

Age Requirements

You must be at least 18 years of age to create an Account and use the Service. By creating an Account, You represent and warrant that You are at least 18 years old and have the legal capacity to enter into these Terms.

Accurate Information

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. Providing false or misleading information may result in termination of Your Account and forfeiture of benefits.

Account Security

You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your Account. You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your Account.

One Account Per Person

Each individual may maintain only one Account. Creating multiple Accounts may result in termination of all Accounts associated with You.

Dependent Enrollment

If Your membership plan includes coverage for dependents, You may enroll eligible dependents including Your spouse and children under the age of 18 (or under 26 if full-time students). Dependents over 14 days old and under 18 years of age may be covered under family plans. You are responsible for providing accurate information for all enrolled dependents and for obtaining any necessary consents.

5. User Responsibilities and Conduct

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

  • In any way that violates any applicable federal, state, local, or international law or regulation
  • To transmit any false, misleading, or fraudulent information
  • To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
  • To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service or any server, computer, or database connected to the Service

Prohibited Activities

You are expressly prohibited from:

  • Submitting fraudulent claims for benefits or services
  • Providing false health information or medical history
  • Using the Service for any purpose not intended by the Company
  • Attempting to circumvent any security measures or access restrictions
  • Reselling, sublicensing, or transferring Your membership to any third party
  • Using automated systems, bots, or scripts to access the Service

Cooperation During Emergencies

When using Emergency Services, You agree to:

  • Provide accurate and complete information about the emergency situation
  • Cooperate fully with emergency coordinators, medical personnel, and service providers
  • Follow reasonable instructions provided by Our assistance team
  • Provide necessary authorizations for medical treatment and transport

6. Subscriptions and Payments

Subscription Period

The Service or some parts of the Service are available only with a paid Subscription. You will be billed in advance on a recurring and periodic basis (such as daily, weekly, monthly, or annually), depending on the type of Subscription plan you select when purchasing the Subscription.

At the end of each period, Your Subscription will automatically renew under the exact same conditions unless You cancel it or the Company cancels it.

Subscription Cancellation

You may cancel Your Subscription renewal either through Your Account settings page or by contacting the Company. You will not receive a refund for the fees You already paid for Your current Subscription period and You will be able to access the Service until the end of Your current Subscription period.

Billing

You shall provide the Company with accurate and complete billing information including full name, address, state, zip code, telephone number, and valid payment method information. By providing payment information, You authorize Us to charge Your payment method for all fees incurred through Your Account.

Payment Methods

We accept major credit cards and other payment methods as indicated on the Website. You are responsible for ensuring that Your payment method is valid and has sufficient funds to cover the Subscription fees.

Failed Payments

If Your payment method fails or Your account is past due, We may suspend or terminate Your access to the Service. We may attempt to charge Your payment method multiple times. You remain responsible for any uncollected amounts.

Fee Changes

The Company, in its sole discretion and at any time, may modify the Subscription fees. Any Subscription fee change will become effective at the end of the then-current Subscription period. The Company will provide You with reasonable prior notice of any change in Subscription fees to give You an opportunity to terminate Your Subscription before such change becomes effective.

Promotional Pricing

Any promotional or discounted pricing is valid only for the specified promotional period. Upon expiration of the promotional period, standard pricing will apply unless otherwise stated in the promotional terms.

Refunds

Except when required by law, paid Subscription fees are non-refundable. Certain refund requests for Subscriptions may be considered by the Company on a case-by-case basis and granted at the sole discretion of the Company.

7. Service Limitations and Exclusions

It is important that You understand the limitations and exclusions that apply to Our services.

Geographic Limitations

  • Travel Assistance: Available only when traveling more than one hundred (100) miles from Your permanent place of residence, and when the trip duration is ninety (90) consecutive days or less
  • Coverage Territory: Coverage applies worldwide unless otherwise specified in Your membership documents

State Availability Restrictions

Important Notice:

  • Travel Assistance Benefits: NOT available to residents of Florida, Connecticut, or New York
  • Helicopter Emergency Benefits: NOT available to residents of Florida or Connecticut

Coverage Maximums

All services are subject to the coverage limits specified in Your membership documents:

  • Evacuation and Medical Repatriation: Up to $100,000 combined
  • Transportation of Mortal Remains: Up to $20,000
  • Transportation of Traveling Companion: Up to $5,000
  • Transportation of Dependent Children: Up to $5,000
  • Helicopter Emergency Transport: Up to $7,000 per occurrence

General Exclusions

Services do NOT cover or include:

  • Injuries or illnesses arising from participation in professional sports or hazardous activities unless specifically covered
  • Self-inflicted injuries or injuries resulting from illegal activities
  • Injuries or illnesses resulting from war, terrorism, or civil unrest in certain regions
  • Elective or cosmetic procedures
  • Routine or preventive care (except as provided through telemedicine)
  • Injuries or illnesses that commenced before the trip began (for travel assistance)
  • Treatment in Your home city or within 100 miles of Your permanent residence (for travel assistance)

Pre-Existing Conditions

Certain services may have limitations related to pre-existing conditions. Please review Your membership documents carefully for specific details about pre-existing condition coverage.

8. Health Information and Medical Disclaimers

Not Medical Advice

The information provided on the Website and through the Service is for general informational purposes only and is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of Your physician or other qualified health provider with any questions You may have regarding a medical condition.

No Doctor-Patient Relationship

Your use of the Website does not create a doctor-patient relationship between You and the Company. A doctor-patient relationship is only established when You engage with a healthcare provider through Our telemedicine service for a consultation.

Emergency Situations

If You believe You have a medical emergency, call 911 or Your local emergency number immediately. Do not rely solely on the Service for emergency medical care. Our emergency assistance services are designed to coordinate and supplement, not replace, local emergency services.

Telemedicine Limitations

Telemedicine consultations have inherent limitations compared to in-person medical examinations. Telemedicine physicians cannot perform physical examinations and must rely on the information You provide. Some conditions cannot be properly diagnosed or treated through telemedicine and may require in-person care.

Your Medical Decisions

You are solely responsible for all decisions regarding Your medical care. The Company does not guarantee any specific medical outcomes. You acknowledge that medical treatment involves inherent risks and that results may vary.

Accuracy of Health Information

You are responsible for providing accurate and complete health information. Inaccurate or incomplete health information may result in inappropriate care recommendations and could be life-threatening in emergency situations. The Company is not liable for any consequences resulting from inaccurate health information provided by You.

9. Third-Party Service Providers

Travel Assist Plus partners with third-party service providers to deliver many of Our services.

Types of Third-Party Providers

  • Telemedicine Providers: Board-certified physicians and healthcare professionals who provide virtual consultations
  • Air Ambulance Services: Medical transport companies providing emergency air evacuation services
  • Helicopter Services: Emergency medical transport providers for helicopter evacuations
  • Emergency Assistance Coordinators: 24/7 assistance providers who coordinate emergency services
  • Healthcare Facilities: Hospitals, clinics, and medical facilities worldwide
  • Payment Processors: Third-party payment services that process subscription payments

Third-Party Terms

Third-party service providers may have their own terms of service, privacy policies, and practices. By using services provided by third parties through Our Service, You agree to comply with their applicable terms. We encourage You to review the terms and policies of any third-party services You use.

Limitation of Responsibility

While We carefully select Our service providers, the Company is not responsible for the acts, omissions, or negligence of third-party service providers. Medical services are provided by independent healthcare professionals who are solely responsible for the care they provide.

10. Emergency Services Terms

24/7 Assistance Hotline

Our 24/7 emergency assistance hotline is available for genuine medical emergencies and travel assistance needs. Misuse of the emergency hotline for non-emergency purposes may result in additional charges or termination of Your membership.

Cooperation Requirements

During an emergency, You agree to:

  • Provide accurate information about Your location, condition, and circumstances
  • Cooperate with Our assistance coordinators and their instructions
  • Authorize necessary medical treatments and decisions when You are unable to do so
  • Provide access to Your ICETracer medical information to emergency responders
  • Cooperate with local emergency services and healthcare providers

Authorization for Medical Decisions

In emergency situations where You are incapacitated and unable to make medical decisions, You authorize the Company and its service providers to make reasonable medical decisions on Your behalf until Your designated emergency contact or legal representative can be reached.

Coordination with Local Services

Our emergency services are designed to coordinate with and supplement local emergency services, not replace them. In many cases, We will work with local emergency responders, hospitals, and medical facilities to ensure You receive appropriate care.

11. User Content

Your Content

You may submit Content to the Service, including but not limited to health information, medical records, documents, and other materials through ICETracer and other features. You retain ownership of any intellectual property rights that You hold in Your Content.

License to Company

By submitting Content to the Service, You grant the Company a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and process Your Content solely for the purpose of providing the Service to You. This license terminates when You delete Your Content or close Your Account, except for Content shared with others or used in connection with emergency services.

Content Standards

You represent and warrant that Your Content:

  • Is accurate and not misleading
  • Does not violate any applicable law or regulation
  • Does not infringe any intellectual property rights of any third party
  • Does not contain any viruses, malware, or other harmful code

Right to Remove Content

We reserve the right to remove any Content that violates these Terms or that We determine, in Our sole discretion, is objectionable or harmful. We are not obligated to monitor Content but may do so at Our discretion.

12. Intellectual Property

The Service and its original content (excluding Content provided by You or other users), features, and functionality are and will remain the exclusive property of the Company and its licensors. The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries.

Trademarks

Travel Assist Plus, ICETracer, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates. You must not use such marks without the prior written permission of the Company.

Limited License

Subject to these Terms, We grant You a limited, non-exclusive, non-transferable, revocable license to access and use the Service for Your personal, non-commercial use. This license does not include any right to:

  • Modify, copy, or create derivative works based on the Service
  • Reverse engineer or attempt to extract the source code of the Service
  • Remove any copyright, trademark, or other proprietary notices
  • Transfer the Service or any rights therein to any third party

13. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Service
  • Your Content or any information You provide
  • Your violation of any rights of a third party
  • Any claim that Your Content caused damage to a third party
  • Your violation of any applicable law or regulation

14. Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service during the twelve (12) months prior to the claim or 100 USD if You haven't purchased anything through the Service.

Exclusion of Certain Damages

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever, including but not limited to:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from unauthorized access to or use of Our servers or any personal information stored therein
  • Damages resulting from any interruption or cessation of transmission to or from the Service
  • Damages resulting from any bugs, viruses, or other harmful code transmitted through the Service

Medical Services Disclaimer

The Company is not a healthcare provider and does not provide medical services directly. Medical services are provided by independent third-party healthcare professionals. The Company is not liable for any medical treatment, diagnosis, advice, or decisions made by healthcare providers, or for any outcomes resulting from such treatment.

Emergency Services Disclaimer

Emergency services are coordinated through third-party providers. The Company is not liable for delays, failures, or inadequacies in emergency response services caused by factors beyond Our reasonable control, including but not limited to weather conditions, geographic limitations, local infrastructure, or the actions of third-party providers.

15. "AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage, or trade practice.

Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems, or services, operate without interruption, meet any performance or reliability standards, or be error-free, or that any errors or defects can or will be corrected.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. In such cases, the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

16. Force Majeure

The Company shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond the Company's reasonable control, including but not limited to:

  • Natural disasters, earthquakes, floods, hurricanes, or other acts of nature
  • Epidemics, pandemics, or public health emergencies
  • War, terrorism, civil unrest, or armed conflict
  • Government actions, laws, regulations, or embargoes
  • Labor disputes or strikes
  • Power outages, telecommunications failures, or internet service interruptions
  • Cyberattacks, hacking, or other security incidents beyond Our reasonable control
  • Failure of third-party service providers

During any force majeure event, the Company's obligations shall be suspended for the duration of the event. We will use reasonable efforts to minimize the impact on You and resume normal operations as soon as practicable.

17. Termination

Termination by Company

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately.

Termination by You

You may terminate Your Account at any time by canceling Your Subscription and contacting Us to request Account deletion. Termination does not entitle You to any refund of fees already paid.

Effect of Termination

Upon termination:

  • Your right to access and use the Service terminates immediately
  • Any pending claims or benefits may be forfeited
  • Your Content stored in ICETracer will be deleted according to Our data retention policies
  • You remain liable for any fees or charges incurred prior to termination

Survival

The following sections shall survive termination: Interpretation and Definitions, Intellectual Property, Indemnification, Limitation of Liability, Disclaimer, Arbitration and Class Action Waiver, Governing Law, and any other provisions that by their nature should survive termination.

18. Arbitration and Class Action Waiver

Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Dallas County, Texas, before a single arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures.

Class Action Waiver

YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both You and the Company agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

Opt-Out

You may opt out of the arbitration agreement by sending written notice of Your decision to opt out to admin@affinitypartners.llc within 30 days of first accepting these Terms. If You opt out, You and the Company may still resolve disputes in court.

Small Claims Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the jurisdiction of the small claims court.

19. Disputes Resolution

Informal Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company at admin@affinitypartners.llc. We will attempt to resolve the dispute informally within 60 days.

Venue

If informal resolution is unsuccessful and the dispute is not subject to arbitration, any litigation must be filed exclusively in the state or federal courts located in Dallas County, Texas, and You consent to the personal jurisdiction of such courts.

Attorneys' Fees

In any action or proceeding to enforce rights under these Terms, the prevailing party shall be entitled to recover its reasonable attorneys' fees and costs.

20. Governing Law

The laws of the State of Texas, United States, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Service may also be subject to other local, state, national, or international laws.

If any provision of these Terms is held to be unenforceable or invalid under the laws of Texas, such provision shall be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions shall continue in full force and effect.

21. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its intent. If such modification is not possible, the provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

The invalidity or unenforceability of any provision in one jurisdiction shall not affect the validity or enforceability of that provision in any other jurisdiction, or of any other provision in any jurisdiction.

22. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by Us on the Service, shall constitute the entire agreement between You and the Company concerning the Service.

These Terms supersede and replace any prior agreements, understandings, or arrangements between You and the Company, whether written or oral, regarding the Service. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

23. Waiver

No waiver by the Company of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of the Company to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

Any waiver must be in writing and signed by an authorized representative of the Company to be effective.

24. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without the Company's prior written consent. Any attempt by You to assign or transfer these Terms without such consent will be null and void.

The Company may freely assign or transfer these Terms without restriction or notice to You. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.

25. State-Specific Notices

California Residents

Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 N. Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210.

Texas Residents

If You are a Texas resident with questions or complaints regarding the Service, You may contact the Texas Attorney General's Consumer Protection Division at (800) 621-0508 or online at www.texasattorneygeneral.gov.

New Jersey Residents

If You are a New Jersey resident, certain provisions of these Terms may not apply to You to the extent they are unenforceable under New Jersey law.

Service Availability
